1. Preamble

The following data protection declaration applies to the use of the website www.stadt-brandenburg.de (hereinafter referred to as the „website“ or „Internet page“) as well as other online services that can be accessed via this website, such as e-mail contact or form services.

We pay close attention to data protection. The collection and processing of your personal data is carried out in compliance with the applicable data protection regulations, in particular the EU General Data Protection Regulation (DSGVO). We collect and process your personal data in order to run the above-mentioned website.

3. General information on data processing

3.1 Legal basis

Insofar as we obtain the consent of the data subject for processing personal data, Art. 6 (1) lit. a EU General Data Protection Regulation (DSGVO) serves as the legal basis.

When processing personal data necessary for the fulfillment of a contract to which the data subject is a party, Art. 6 (1) lit. b DSGVO serves as the legal basis. This also applies to data processing that is necessary for the fulfillment of pre-contractual measures.

Insofar as processing of personal data is necessary for the fulfillment of a legal obligation to which our company is subject, Art. 6 (1) lit. c DSGVO serves as the legal basis.

In the event that vital interests of the data subject or another natural person make processing of personal data necessary, Art. 6 (1) lit. d DSGVO serves as the legal basis.

If the processing is necessary for the performance of a task in public interest, Art. 6 (1) lit. e DSGVO serves as the legal basis for the processing.


3.2 Collection of data from third parties

In principle, the controller collects personal data from the data subject. If the controller exceptionally collects data from third parties, the data subject will be informed in accordance with the requirements of Art. 14 DSGVO, including the source of the data.


3.3 Data transfers

The Controller transfers personal data exclusively on the basis of legal provisions or with the consent of the data subject.


3.4 Data deletion and storage period

The personal data of the data subject shall be deleted or blocked as soon as the purpose of storage ceases to apply. Storage may take place beyond this if this has been provided for by the European or national legislator in Union regulations, laws or other provisions to which the person responsible is subject. Blocking or deletion of data will also take place if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfillment of a contract.


3.5 Notification in the event of a data protection breach

In the event of a data protection breach, the responsible party will notify the competent data protection supervisory authority. If the breach results in a high risk to the personal rights and freedoms of a natural person, the Controller will notify the data subject without undue delay.

4. Data subject rights

4.1 Information, correction, deletion, restriction

Every data subject has

a) according to Art. 15 DSGVO, an individual right to information about their personal data processed by the Controller.

b) according to Art. 16 DSGVO, the right to request the controller to correct inaccurate personal data or to supplement incomplete personal data,

c) the right to request the controller to erase the personal data in question pursuant to Art. 17 DSGVO; and

d) under the conditions of Art. 18 DSGVO, the right to demand the restriction of data processing.
 

4.2 Objection

The data subject may object, on grounds of a particular situation, to the processing of his or her personal data for the performance of tasks pursuant to Art. 21 (1) DSGVO, unless the controller can demonstrate legitimate grounds for further processing.


4.3 Data portability

If the processing is carried out with the aid of an automated procedure on the basis of the data subject's consent, the data subject has the right to request that his/her data be made available in a structured, common and machine-readable format.


4.4 Right of revocation

If the processing of personal data is based on the data subject's consent, he or she has the right to revoke this consent at any time with effect for the future. The data subject will be informed of the right of revocation and in what manner this right can be pursued.


4.5 Right of complaint

5. Use of the website and other online offers

5.1 Access data

In principle, you can visit the municipal website without registering, i.e. personal data is not collected. However, the following information is automatically stored within the scope of Art. 6 (1) lit. e DSGVO:

- Behavior on the website (title and URL of the web pages accessed, date and time of access, time taken to load the website, time spent on the website, clicks on files and external links on the website).
- User's terminal device (browser type with version and plugins, default browser language setting, operating system, display resolution, device type, make and model)
- time in the user's time zone, user's location
- anonymized (incomplete) IP address of the computer, random visitor ID with information about the time and number of visits to the website in the past).

This data is basically analyzed for statistical purposes (see chapter 5.3 „Matomo“).

Beyond the mere visit of the website, however, personal data is collected and processed when using our service offer of online forms (see chapter „Forms“).


5.2 Cookies

When accessing our Internet pages, small files, so-called cookies, are stored locally in the cache of the Internet browser of the page visitor. Among other things, the cookies enable the recognition of the Internet browser. Cookies are used to collect anonymous statistical data and to make it easier for visitors to navigate the website.

You can determine the storage of cookies yourself by setting your browser software accordingly. If you do not agree with the storage and use of your data, you can deactivate them or allow them again at any time. For this purpose, the German Federal Office for Information Security has prepared detailed instructions for the secure configuration of the most widely used Internet browsers.


5.3 Matomo (tracking of visits)

On this website, data is collected and stored using the web analytics service software Matomo (www.matomo.org) (formerly Piwik), a service of the provider InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand, based on our legitimate interest in the statistical analysis of visitor traffic for optimization purposes in accordance with Art. 6 (1) lit. e,f DSGVO. Pseudonymized usage profiles can be created and evaluated from this data for the same purpose. Cookies can be used for this purpose (see above). The data collected using Matomo technology (including your pseudonymized IP address) is processed on our servers.

This analysis is carried out anonymously; it is therefore not possible to draw conclusions about a specific person or to create user profiles. The transmitted data is used exclusively for internal statistical purposes.

Objection

If you do not agree with the storage and analysis of this data from your visit, then you can object to the storage and use at any time by removing the tick in the checkbox in the following dialog box. In this case, a so-called opt-out cookie will be stored in your browser, with the result that Matomo will not collect any session data. Please note that the complete deletion of your cookies means that the opt-out cookie will also be deleted and may have to be reactivated by you.

5.4 Active components

Active components such as Javascript or Java applets are used on the website of the city of Brandenburg an der Havel. You can disable this function by setting your Internet browser. However, it cannot then be ruled out that individual Internet services will not be available or will only be available to a limited extent.


5.5 Browser configuration

When you surf the Internet, you are basically transmitting data. However, you have the option of configuring your web browser and determining for yourself which data you transmit while surfing. To this end, the German Federal Office for Information Security has produced detailed instructions on the secure configuration of the most widely used Internet browsers.


5.6 Social media and social plugins

Due to data protection concerns, the City of Brandenburg an der Havel does not use social plugins, such as the Facebook Like button, on its websites. Connections to social media are only offered via a simple link to the respective website, such as the Facebook fan page or the Twitter channel. Excluded are videos that are uploaded to Youtube or other video platforms and are integrated via a so-called iframe on this website. Here, we try to use the strictest data protection options of the platform operators.

The visit and use of interaction functions is possible on the linked websites of the social media. Here, the data protection information and the settings options for the protection of privacy of the respective provider of the social media should be observed. On the page „Social media“ you will find information on the presences of the city of Brandenburg an der Havel in the social networks as well as detailed information on data protection when visiting these profiles.


5.7 Forms

If you use our service offer of online forms (e.g. by filling out a form), your personal data will only be collected and processed by us to the extent that it is actually necessary for the provision of the service.

The data will be deleted when their knowledge is no longer required for the fulfillment of the respective task and after expiration of the legal archiving requirements. This does not apply if the City of Brandenburg an der Havel is legally obligated to release the collected data. The deletion of the data is governed by Art. 17 DSGVO.

If you use these services (e.g. contact forms), the same requirements apply as explained in the chapter „E-mail“ (point 4.8.).

PDF forms

For some services, we offer electronic forms that you can download, print out, sign personally, and submit to the processing office. In some cases, it is possible to send completed PDF forms online.

To do this, you will need the free PDF program Adobe Reader. Other PDF programs also allow you to view and download the forms, but you must print and mail them to complete them.

Interactive applications

In interactive applications, data is transmitted to the executing agencies in encrypted form.

Electronic forms with secure proof of identity

The city of Brandenburg an der Havel does not offer business transactions via electronic forms with secure proof of identity.

5.8 Online payment

Personal data is collected when using the online payment system between the services of FormSolutions e.K.. (see section 5.7 Forms), GovConnect GmbH and the city administration. The data processing is carried out on the basis of a data protection agreement for commissioned data processing in accordance with Art. 28 DSGVO.


5.9 E-mail

If you send data to the City of Brandenburg an der Havel by e-mail (also applies to contact forms), the data and content associated with the e-mail will be used exclusively for contact with you. E-mails and the data and content associated with them are deleted as soon as they are no longer required for the fulfillment of tasks within the responsibility of the City of Brandenburg an der Havel.

If you send information in e-mails to the city of Brandenburg an der Havel, this is always done unencrypted. This means that your data can in principle be read or even falsified by third parties. We recommend that you send confidential information by mail. In individual cases, the sender and recipient may agree on a common encryption method.

No executable code, automated procedures, programming (macros) or password protection may be used in any file attachments.

Other formats will only be accepted with the express permission of the City Council. If your file attachments cannot be processed, you will be notified as soon as possible.

The total size of an e-mail including all attachments is limited to a size of 20 MB. Larger e-mails cannot be processed technically.

Electronic signature

E-mails with qualified electronically signed documents can be delivered to the mail addresses of the city of Brandenburg an der Havel. Please note that only qualified electronically signed documents can replace a legally mandated written form.

The City of Brandenburg an der Havel only accepts signatures created with the certificate of a certification service provider accredited with the Federal Network Agency. An overview of providers can be found on the website of the Federal Network Agency.

Here, the files with signature must comply with the PKCS#7 standard and be created as a PKCS#7 MIME message (file extension .p7m). Alternatively, the signature can be embedded in a PDF file.

The remote signature variant, where the signature (.p7s) and signed data are stored in two separate files, is not supported by the municipality. Each document must be signed separately.

Security

The city of Brandenburg an der Havel uses software to filter unwanted e-mails (spam filter). The spam filter can reject your e-mails because they have been falsely identified as spam by certain characteristics. E-mails that contain executable programs are also rejected.

E-mails that contain a virus will not be accepted. You will not receive any information about this. Files attached to an e-mail that have been converted into self-extracting *.exe files or that contain automated procedures or programming (e.g. macros, *.bat) will not be accepted.

De-Mail

The city of Brandenburg an der Havel does not offer business transactions via De-Mail services.

Possible problems with e-mail traffic

If you send an e-mail to the employees of the city administration of Brandenburg using MS-Outlook, problems may occur during reception. This happens especially if the e-mail was written and sent in Rich Text Format (RTF). RTF is only supported by Microsoft Exchange and Outlook. However, you can easily convert the rich text format to a text or HTML format.

Starting from Outlook version 2007, follow this way:

1. Once you have opened the message, click on the „Other Actions“ drop-down list in the „Message“ tab in the „Actions“ group.
2. From the list, select the „Edit Message“ entry as well as „Options“ and finally „Text Only“.

If you need to access it frequently, you can put a command button for it in the DeepL access bar:

1. Right-click the DeepL access bar and select the „Customize toolbar for DeepL access“ entry.
2. From the „Select Commands“ drop-down list, select the „All Commands“ entry and find the „Edit Message“ entry in the window below it.
3. Select it, click „Add“ and confirm with „OK“.
